ITC Judge Rules Against Qualcomm For Nokia

Dec 13th 07 – An International Trade Comission (ITC) judge has just ruled against Qualcomm in the latest in a series of legal setbacks for the company. The case concerns three patents Qualcomm claimed Nokia was infringing upon. The patents focused on how cell phones manage power to extend battery life. The judge found in his initial determination that “there is no violation” (the determination can be read here as a PDF file).

Qualcomm has said that they will be petitioning the ITC for a review of the Judge's determination, which won't happen until the 14th of April 2008. In the meantime, Nokia is free to import phones into the USA that use the technologies covered by the disputed patents. Rick Simonson, Chief Financial Officer of Nokia blasted Qualcomm in a statement, claiming that “this decision confirms our belief that Qualcomm does not have relevant GSM patents. This is another failed attempt by Qualcomm to mislead both Nokia and the telecommunications industry.” Qualcomm's only comment was to say that “under applicable ITC rules, Qualcomm intends to petition the Commission for review of the ID (Interim Determination)."

Qualcomm has faced several legal setbacks recently, including an ITC ruling earlier this year that they infringed on patents held by Broadcomm.
