ITC Has Two Weeks to Justify Qualcomm Ban

A federal court of appeals yesterday gave the International Trade Commission (ITC) two weeks to justify its recent order banning the import of cell phones that use certain Qualcomm 3G chips. On June 7 the ITC banned importation of cell phones that use Qualcomm chips to access high speed third generation networks. This ban was the result of a patent infringement suit brought against Qualcomm by Broadcom Corp.

The U.S. Court of Appeals for the Federal Circuit has asked the ITC to justify its ban during the appeals process. The ITC has until June 27 to respond to the court's request. Several third parties, including Verizon Wireless and LG Electronics Co. Ltd., have asked President Bush to veto the ITC's decision arguing that the ban would adversely impact their business. The ITC's ban as currently constituted only applies to new imports that contain the Qualcomm chipset in question.
